There are more than 1.5 million condominium units in Florida operated by nearly 28,000 associations, according to a legislative analysis conducted in 2022. Of those, more than 912,000 are older than 30 years and are the home to more than 2 million residents.
On May 26, 2022, Florida Governor Ron DeSantis signed Senate Bill SB 4-D: Building Safety. This statute states that all condominium or cooperative buildings that are 25 or 30 years of age, with three or more floors in height must conduct structural integrity assessments known as Milestone Inspections. All Phase One Milestone Inspections must be filed with the local building departments by the end of 2024.
Per the bill, a milestone inspection is defined as a structural inspection of the building, including all load-bearing walls, primary structural members, and primary structural systems of all habitable and non-habitable areas and consists of two phases. Phase One is visual evaluation of the building that includes a written assessment and Phase Two is an additional inspection that is only required if the Engineer or Architect who performed the Phase One inspection deems it necessary based on its findings.
